Terms of Use
Last updated:
The conditions for using the ScaleWest website and learning about our services.
1. About these terms
This website is operated by Scale West Ltd. (Скейл Уест ЕООД), company registration number (EIK) 204514691, Sofia, Bulgaria, trading as ScaleWest. Contact: [email protected].
These Terms of Use describe the conditions for accessing our public website, reading its content and contacting us. Please use the website in accordance with these terms and applicable law. If you do not agree with them, discontinue use. These terms do not replace any rights or protections that cannot lawfully be excluded.
2. Website information and our services
The website describes our software development, dedicated team and consulting capabilities for prospective business clients. Information, examples, estimates and enquiry forms are invitations to discuss a project, rather than a binding offer or a promise of availability, pricing, delivery dates or outcomes. A message or an automated acknowledgement does not create a services agreement.
Any engagement requires a separate agreement defining the scope, deliverables, fees, acceptance process, support, confidentiality, security obligations and allocation of responsibilities. If those agreed terms conflict with these website terms, the agreed terms govern that engagement.
Ownership and licensing of software, source code, designs, pre-existing tools, open-source components and project deliverables are determined by the relevant project agreement and applicable licences. Nothing on this website transfers ownership of a client's technology or grants us rights over information beyond those needed to handle the enquiry.
3. Acceptable use
You may browse the website and use it to learn about and contact ScaleWest for lawful purposes. You must not:
- attempt unauthorised access to accounts, infrastructure, private data or non-public systems;
- introduce malware, exploit vulnerabilities, disrupt availability or bypass security or anti-spam controls;
- send unlawful, fraudulent, threatening or unsolicited bulk communications, impersonate another person or misrepresent your authority to act for a business;
- copy, republish or commercially exploit protected website content without permission or another lawful basis; or
- infringe intellectual property, confidentiality, privacy or other rights.
If you discover a vulnerability, report it to [email protected]. Do not access other people's data or conduct disruptive testing without prior written authorisation.
4. Intellectual property and case studies
Website text, designs, graphics and other materials are owned by ScaleWest or used with the relevant rights. You may view them and retain reasonable excerpts for internal evaluation of our services, keeping applicable notices intact. Wider use requires permission unless an exception under applicable law applies.
Client names, logos, trademarks and third-party materials remain the property of their respective owners. Their appearance does not grant a licence to use them or imply an endorsement beyond the relationship described.
Case studies and testimonials describe particular projects and circumstances. Their results are not a guarantee of results for another business. Project outcomes depend on factors such as scope, budget, implementation, client participation and market conditions.
5. Contacting us and sharing information
Please provide accurate contact details and share only information you are authorised to disclose. Avoid sending confidential business material, credentials or sensitive personal information through an initial enquiry. If confidential technical discussions are needed, ask us to put appropriate confidentiality arrangements in place first.
You retain your rights in the material you send. We may use it to assess and respond to your enquiry and discuss the proposed relationship. Personal data is handled as explained in our Privacy Policy. Sending an enquiry does not opt you into unrelated marketing.
6. External services and links
The website uses or links to third-party services, including reCAPTCHA, media, advertising integrations and LinkedIn. Those services operate under their own terms and privacy notices. We do not control external websites or guarantee their content, security or availability. A link is provided for convenience and does not by itself constitute an endorsement.
7. Accuracy and availability
We aim to provide useful, current information, but website material may contain errors or become out of date. Content is provided for general information and is not legal, financial, security or other professional advice tailored to your circumstances. Please confirm any detail material to a business decision directly with us.
We may update, suspend or discontinue parts of the website for maintenance, security or business reasons. Continuous availability, compatibility with every device and error-free operation are not guaranteed. We may restrict access where reasonably necessary to address misuse or protect the website.
8. Responsibility and limitations
To the extent permitted by applicable law, the website and its informational content are provided as available without additional warranties about suitability for a particular purpose. We are not responsible for losses caused by reliance on general website information instead of obtaining a specific written commitment, or for third-party sites outside our control.
Nothing in these terms excludes or limits responsibility for fraud, intentional misconduct, gross negligence, injury or other liability to the extent it cannot lawfully be excluded or limited. Mandatory consumer rights remain unaffected. Responsibility for paid services is governed by the relevant services agreement and applicable law, not by a website disclaimer.
9. Applicable law and disputes
These website terms are governed by Bulgarian law, subject to any mandatory protections that apply to you. Please contact us first if there is a concern so we can try to resolve it constructively; doing so is not a precondition to exercising a legal right.
Disputes may be brought before the courts competent under applicable law. These terms do not deprive a consumer of mandatory protections or a right to bring proceedings in another court where the law provides that right.
10. Changes and contact
We may update these terms for changes to the website, our business or legal requirements. The date above identifies the version. Updates apply prospectively and do not amend an existing project agreement without the agreement required by that contract. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
